Fentanyl Pain Patch Lawsuit

A mass tort claim has been filed in the Philadelphia Court of Common Pleas on behalf of Jose Campuzano of San Leandro, California. The lawsuit alleges that Campuzano’s wife, Charlene Manzo, died as the result of an overdose from Fentanyl patches used to control pain.

Mylan Inc., Mylan Pharmaceuticals Inc., and Mylan Technologies Inc. are the defendants named in the suit. The plaintiff claims that the manufacturers of the Fentanyl patch knew the product posed dangers to the consumer, but did not disclose the danger to federal regulators, prescribing medical professionals or the public.

The lawsuit alleges that Manzo was given a prescription from her doctor for 100 mcg and 75 mcg Fentanyl patches. Manzo died on Jan. 9, 2010. Toxicology results after her death showed she had a blood-fentanyl concentration of 20 ng/ML, which is potentially lethal. The complaint further alleges that a concentration of 4.2 ng/ML is the mean maximal dosage that the 100 mcg Mylan fentanyl patch and 75 mcg Mylan fentanyl patch are designed to deliver. The complaint further asserts the Manzo did not abuse the fentanyl patch or used them inappropriately. Also, that the defendant’s patches were defective in that they exposed the decedent to an excessive and deadly amount of fentanyl.
