Hurricane Harvey Inverse Condemnation Claim

Hurricane Harvey has caused devastating floods in Houston. But, many of those flooded along Buffalo Bayou would not have flooded but for the release of water from the Addicks and Barker Reservoirs. By intentionally releasing so much water into Buffalo Bayou, the Army Corps of Engineers knowingly condemned the property of many homeowners. Additionally, they caused already flooded homes to be flooded worse and for a longer period of time. Homes along the San Jacinto River were similarly flooded by the release at the Conroe Dam.

The Fifth Amendment of the United States Constitution includes a provision known as the Takings Clause, which states that “private property [shall not] be taken for public use, without just compensation.” The Takings Clause imposes two requirements on government to protect its citizens — the property to be acquired must be “for public use,” AND the government must pay “just compensation” to the owner of the property that is taken.

How was Harvey Flooding Different than other floods?

The Army Corps of Engineers and the SJRA basically sacrificed some homeowners land for save others. This was done intentionally. My argument is that they must simply compensate those people who sacrificed their property like the 5th Amendment mandates.

Hurricane Harvey Class Action?

A class action is not my first choice. Some lawyers have filed class action law suits. My first preference is to seek individual relief. One law suit for each client.
